 Kimberly,

I only asked because I wanted to make sure no one else was trying to use your info.

I appreciate your passion in regard to this issue as it is your business and your livelihood but I need to be honest and please, know I mean no offense.  The Chamber is not a regulatory agency so I do not need all the exstranious info.  All I need are the basic facts of what you are dealing with because when I contact someone at Akamai, that’s all they are going to want -  not a multi-paragraph email - which to be honest, may cause people to not read your entire message.

 Again, I mean no disrespect.

 Thanks,

Kelly

Dear Kelly Thompson Clark CEO,

Why does the Cambridge Chamber of Commerce in Cambridge Massachusetts look the other way while one of your members refuse to obey trademark laws where you allow Akamai Technologies to host a disreputable company like Groupon.com who blatantly infringe my Boston Electrolysis Trademark? Kelly is this what we call the "Cambridge Double Standard" where the Cambridge Chamber of Commerce looks the other way and allowing their member Akamai Technologies Hosting Company to openly defy their own Acceptable Use Policy where they allow Groupon.com to steal my identity and use my Boston Electrolysis® Trademark to commit bait and switch tactics? Kelly, I wonder why local laser parlors in the Boston Cambridge area need to advertise as Boston Electrolysis®? Kelly where are the Cambridge Chamber of Commerce business ethics that protect local consumers against illegal Bait & Switch Tactics by Groupon.com hosted by Akamai Technologies?

For your information First, I would like to make you aware that on April 14, 2009, the Federal government awarded to me United States Registration No. 3,601,889 for the trademark Boston Electrolysis®.  This Federal registration constitutes prima facie evidence of the validity of the trademark and its registration, and of my (the trademark owner’s) exclusive nationwide right to use the mark in commerce in connection with providing hair removal services.  The registration also constitutes notice to all parties that the trademark Boston Electrolysis® is the exclusive property of me, Kimberly Williams R.E., Dean. In addition my trademark renewal granted me an “Uncontestable Trademark’’ status and you verify it at http://www.uspto.gov/trademarks/.

Thank you,

 Kimberly

Dear Kelly I have had to resort to paid Google Ads on top of the page  because Groupon.coms assault on my websites has lowered my website ranking to lower page because the Cambridge Chamber of Commerce refuses to implement their own rules and regualtion. Not only is Groupon.com advertising  as Boston Electrolysis and in this http://www.groupon.com/local/boston/electrolysis they have become so brazen they have inserted “<title>Boston Electrolysis - Deals.

in Boston | Groupon</title>”into the source page " In addition the have inserted Boston Electrolysis 17 times on page http://www.groupon.com/local/boston/electrolysis and that does not include the cloaked text they are using. Akamai  Technologies has ignored pleas and have refused to contact me in any form or manner and I can’t help but think this is personal hate attack upon myself because I am transgendered and their going out of their way to say we can steal what we want from Boston Electrolysis. Take a look at the latest Groupon.com advertising as Boston Electrolysis on the attached pdf.file. In addition they are impersonating me by offering Boston Electrolysis dealsand discounts. Kelly one more item when they use Boston/Electrolysis with a slash on source page text the Googlebot spider does not index the slash so it is indexed as Boston Electrolysis. Hosting companies and website that lie use this dishonest tactic.

Kelly here is a link to Google that shows how Groupon.com is a rip off http://www.google.com/#q=groupon.com+is+a+rip+off&safe=off and it might give you some leverage with Akamai Technologies for hosting them. However I wonder if the CEO of Akamai Technologies is aware of what’s going on?

This is a copy of Groupon.com advertising as Boston Electrolysis from today,

Boston Electrolysis - Deals in Boston | Groupon

www.groupon.com/local/boston/electrolysis Groupon
Electrolysis deals in Boston: 50 to 90% off deals in Boston.

Two or Four 30- Minute Electrolysis Sessions at Total Skin Care (50% Off)

Sincerely,

Kimberly

Kelly Take a look at the attached source page for http://www.groupon.com/local/boston/electrolysis and they have stuffed Boston Electrolysis into the source page files 17 times including the title page.

Kimberly, I just got your second email.  I was away on vacation and my VM stated so as did an auto-reply set with my email.  I was not responding while I was away.

I looked at your attachment and am asking you to please, in short, remind me of the wrongful use of your info.  Is your website listed improperly under the ad or is this not your ad at all?  I want to make sure I am up-to-date so I can relay the correct info to Akamai.  FYI, I did leave two messages for the person you had tried to contact and he has never returned  my calls either.

     Dear Kelly,

When Akamai Technologies joined the Cambridge Chamber of Commerce they became indentured as a company that stands for honesty and integrity. On the other hand Akamai Technologies refuses to comply with the rules and regulations of the Cambridge Chamber of Commerce and Internet Law. Kelly Akamai Technologies is violating the law and using it’s Cambridge Chamber of Commerce membership to appear as an honest company. It’s wrong and you know it and as long as the Cambridge Chamber of Commerce looks the other way Akamai Technologies will let Groupon.com stealing hits from my Boston Electrolysis websites. Groupon.com is diluting the value of my trademark because of hateful discrimination and it is most evident and visit this Google link and see https://www.google.com/?gws_rd=ssl#q=boston+electrolysis&safe=off . You can see Groupon.com openly advertising Boston Electrolysis Deals on Google and displacing my websites.

Like other internet businesses Groupon.com is hosted by Akamai Technologies of Cambridge, Massachusetts who’s Acceptable Use Policy for intellectual property rights is listed on the following website page below www.akamai.com/html/policies/acceptable_use.html. However I have copied and pasted their intellectual property statement below.

    Akamai Intellectual Property

“Customer shall not use the Akamai Network and Services in any manner that would infringe, dilute, misappropriate, or otherwise violate any privacy or other personal rights or any intellectual property rights, including but not limited to, copyrights and laws protecting patents, trademarks, trade secrets or other proprietary information. If Customer uses a domain name in connection with its use of the Akamai Network and Services, such domain name must not violate any trademark, service mark, or other rights of any third party.”

Kelly Akamai Technologies openly and blatantly is violating their own rules and regulations and the law by allowing their customer Groupon.com to do as they wish? Is this how the Cambridge of Commerce allows crooked businesses to steal whatever the want?

Kelly on page http://www.akamai.com/html/policies/code_ethics.htm Akamai Technologies Code of Ethics Policy. I take note where they claim and state, “Allow any illegal, unsafe, or abusive behavior in the workplace, including harassment or discrimination of any kind.” On the other hand I cannot understand why they allow Groupon.com to vindictively assault my trademarked business name? One must conclude they can do what they want nevertheless in my opinion they dislike transgendered women because they look the other way whilst Groupon.com infringes and abuses my trademark.  Akamai Technologies code of ethics do not apply to minorities like myself and you have wonder who they do apply to? The dishonest websites? Below is a list of Akamai Technologies Ethics.

Dismiss ideas from any source without consideration.

    Promise what we cannot deliver.

Violate the trust of customers, their clients, business partners, employees, or shareholders.

Allow any illegal, unsafe, or abusive behavior in the workplace, including harassment or discrimination of any kind.

Veer from our Statement of Purpose and Guiding Principles

Kelly I am disappointed the you have not replied to my phone calls and emails and when a company who belongs to the Cambridge Chamber of Commerce can refuse to obey the law. It becomes frustrating to the point that I will publish a detailed article about the entire situation including the apathy of the Chamber of Commerce who has failed to reprimand Akamai Technologies and Groupon.com who believe they are above the law that entitles them to twist, break and abuse the law whenever they please.

If you want to know why that America is behind the eight ball it’s because people in positions of authority look the other the other way and since not one person can stand up and say no that’s wrong people will blatantly break the law and create more victims. Kelly Trans-women are assaulted in many ways and the FBI states that one out twenty-one Trans-women will be violently assaulted or murdered because people look the other way.

In summation if the Cambridge Chamber of Commerce fails to reprimand Akamai Technologies by refusing to enforce their own rules of law than every reader in Boston, Cambridge and the Metro-Area will learn the truth. Kelly whether you realize or not Trademark Infringement is a felony and  this is a hate crime because I do not see this happening to another electrologist in the entire USA. Kelly the Boston area has the highest violent crime rated against Trans-women including murder.

Kelly I dislike writing articles of this nature to defend myself from haters who steal my trademark whenever they feel like it but this is this worst I have experienced and it’s because the Cambridge Chamber of Commerce looks the the way while Groupon.com and Akamai Technologies violates my intellectual property rights with impunity,

Kelly Read it here http://www.fenwayhealth.org/site/News2?page=NewsArticle&id=7645&news_iv_ctrl=0&abbr=FCHC_. also take a look at the pdf.file and see Groupon.com advertising as Boston Electrolysis Deals.
